General provisions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">1.1. These Terms of Use, hereinafter \u2014 <strong>the \u201cTerms\u201d<\/strong>, govern access to the SafeCore website located at:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/safecore.com.ua\/en\/\"><strong>https:\/\/safecore.com.ua\/en\/<\/strong><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">as well as the use of its pages, materials, features, contact forms and other content available through it, hereinafter together \u2014 <strong>the \u201cSite\u201d<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.2. The owner and operator of the Site is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>LIMITED LIABILITY COMPANY \u201cSafeCore\u201d<\/strong><br>Short name: <strong>LLC \u201cSafeCore\u201d<\/strong><br>USREOU code: <strong>45686513<\/strong><br>Registered address: <strong>Ukraine, 04070, Kyiv, 33 Petra Sahaidachnoho Street<\/strong><br>Email: <a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hereinafter \u2014 <strong>\u201cSafeCore\u201d<\/strong>, <strong>the \u201cCompany\u201d<\/strong>, <strong>\u201cwe\u201d<\/strong>, <strong>\u201cus\u201d<\/strong> or <strong>\u201cour\u201d<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.3. The <strong>\u201cUser\u201d<\/strong> or <strong>\u201cyou\u201d<\/strong> means any natural or legal person who visits, views or otherwise uses the Site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.4. By using the Site, you confirm that you have read these Terms, understand them and agree to comply with them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.5. If you do not agree with these Terms, stop using the Site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.6. If you use the Site on behalf of a legal entity, you confirm that you have due authority to act on its behalf.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">2. Purpose of the Site<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. The Site serves informational, presentational and communication purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. Through the Site, SafeCore may publish information about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Company and its areas of activity;<\/li>\n\n\n\n<li>solutions in information technology and cybersecurity;<\/li>\n\n\n\n<li>software, hardware and technologies;<\/li>\n\n\n\n<li>implementation, integration, consulting, technical maintenance and support services;<\/li>\n\n\n\n<li>manufacturers, suppliers, technology partners and third-party solutions;<\/li>\n\n\n\n<li>news, events, publications, research and informational materials;<\/li>\n\n\n\n<li>vacancies and cooperation opportunities;<\/li>\n\n\n\n<li>ways to contact SafeCore.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">2.3. The Site is not an online shop, a marketplace or an automated contracting system, unless expressly stated otherwise on a particular page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4. Information on the Site is not a public offer, a guarantee that a contract will be concluded, or an unconditional obligation of SafeCore to provide a particular product, service, price, deadline or result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.5. Sending a message, an application, a request for consultation, contact details or any other enquiry through the Site or by email:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not mean that an order is automatically accepted;<\/li>\n\n\n\n<li>does not create a contractual relationship;<\/li>\n\n\n\n<li>does not guarantee that a product or service will be provided;<\/li>\n\n\n\n<li>does not mean that the price, deadline, technical specification or other material terms have been agreed;<\/li>\n\n\n\n<li>does not establish a relationship of exclusivity, representation, partnership or agency.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">2.6. Commercial relations with SafeCore arise only on the basis of a separate contract, order, specification, invoice, technical specification, licence agreement or other document agreed by authorised parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.7. If a separate contract with SafeCore conflicts with these Terms, the provisions of that contract prevail in respect of the subject matter it governs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">3. Informational materials on IT and cybersecurity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The Site may contain materials on information technology, cybersecurity, network infrastructure, information protection, risk management, software, hardware, cloud technologies and other technical matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. Such materials are provided for general information only and do not constitute individual technical, legal, audit, regulatory or other professional advice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.3. Information on the Site does not take into account every particularity of a specific information system, organisation, infrastructure, threat model, industry requirement or legislation applicable to a specific User.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.4. Before applying any technical recommendation, architecture, configuration, command, script or other material, the User must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>independently assess whether it meets their needs;<\/li>\n\n\n\n<li>verify compatibility with their own infrastructure;<\/li>\n\n\n\n<li>carry out testing in a safe environment;<\/li>\n\n\n\n<li>create the necessary backups;<\/li>\n\n\n\n<li>apply appropriate change management procedures;<\/li>\n\n\n\n<li>consult qualified specialists where necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">3.5. No information on the Site is to be treated as a guarantee of absolute security, the absence of vulnerabilities, uninterrupted operation or compliance with a particular standard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.6. Cybersecurity depends, among other things, on system configuration, the actions of personnel, updates, external threats, third-party components and the User\u2019s own processes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">4. Right to use the Site<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. Subject to compliance with these Terms, SafeCore grants the User a limited, non-exclusive, revocable, non-transferable right to use the Site for lawful informational and internal business purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. The User may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>view publicly available pages;<\/li>\n\n\n\n<li>contact SafeCore using the published contact details;<\/li>\n\n\n\n<li>download materials where such a feature is expressly provided;<\/li>\n\n\n\n<li>print individual materials for personal or internal corporate use;<\/li>\n\n\n\n<li>place ordinary links to publicly available pages of the Site.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">4.3. Granting access to the Site does not transfer to the User any title to the Site, its content, design, software components, databases or other intellectual property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">5. Prohibited use<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. When using the Site, it is prohibited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>violate the legislation of Ukraine, mandatory rules of European Union law or other applicable legislation;<\/li>\n\n\n\n<li>use the Site for fraud, deception, harassment, discrimination or other unlawful activity;<\/li>\n\n\n\n<li>impersonate SafeCore, its employee, representative or partner;<\/li>\n\n\n\n<li>create a false impression of a partnership, certification, endorsement or other relationship with SafeCore;<\/li>\n\n\n\n<li>copy, modify, translate, publish, sell, license or commercially exploit a substantial part of the materials of the Site without written permission;<\/li>\n\n\n\n<li>carry out systematic scraping, parsing, automated collection, copying or downloading of content;<\/li>\n\n\n\n<li>use the content or structured data of the Site to train, test or improve artificial intelligence models without the prior written permission of SafeCore, except where expressly permitted by applicable law;<\/li>\n\n\n\n<li>use robots, crawlers or automated agents in a way that creates an excessive load;<\/li>\n\n\n\n<li>circumvent CAPTCHA, visitor verification systems, rate limits, authentication tools or other protection mechanisms;<\/li>\n\n\n\n<li>interfere with the operation of the Site, servers, networks, monitoring systems or related infrastructure;<\/li>\n\n\n\n<li>distribute viruses, ransomware, trojans, spyware or other malicious code;<\/li>\n\n\n\n<li>carry out unauthorised scanning, penetration testing, password brute-forcing, traffic interception, exploitation of vulnerabilities or denial-of-service attacks;<\/li>\n\n\n\n<li>obtain or attempt to obtain access to non-public pages, accounts, systems or data;<\/li>\n\n\n\n<li>remove copyright, trademark or other legal notices;<\/li>\n\n\n\n<li>use the Site to develop, distribute or support malicious cyber operations;<\/li>\n\n\n\n<li>assist another person in committing any of the prohibited actions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">5.2. The public availability of the Site is not permission to carry out security testing of the Site or of any other SafeCore resource.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">6. Reporting potential vulnerabilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. If you have discovered a potential vulnerability of the Site in good faith, report it by email:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is recommended to use the subject line: <strong>\u201cVulnerability report\u201d<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2. It is advisable to supplement the report with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the address of the resource concerned;<\/li>\n\n\n\n<li>a description of the potential issue;<\/li>\n\n\n\n<li>safe steps to reproduce it;<\/li>\n\n\n\n<li>an assessment of the possible impact;<\/li>\n\n\n\n<li>contact details for a reply.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">6.3. When verifying a potential vulnerability, it is prohibited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>access other people\u2019s data;<\/li>\n\n\n\n<li>copy, modify or delete data;<\/li>\n\n\n\n<li>disrupt the availability of the Site;<\/li>\n\n\n\n<li>use social engineering, phishing or malicious software;<\/li>\n\n\n\n<li>demand a reward under threat of disclosure;<\/li>\n\n\n\n<li>publicly disclose technical details before SafeCore has been given a reasonable period to verify and remedy the issue.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">6.4. This section is not automatic permission to carry out testing, does not create a bug bounty programme and does not release anyone from liability for unlawful or bad-faith actions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">7. Intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. The Site and its materials, including texts, graphics, photographs, video, documents, presentations, illustrations, icons, logos, design, structure, software code and databases, may be subject to copyright, trademark rights and other intellectual property rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. Unless expressly stated otherwise, these rights belong to SafeCore, its licensors, suppliers, partners or other relevant rightholders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. No exclusive economic intellectual property rights are transferred to the User.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.4. Limited quotation of materials is permitted in the cases and within the limits established by applicable law, provided that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>SafeCore is identified as the source;<\/li>\n\n\n\n<li>an active link to the relevant page is added when used online;<\/li>\n\n\n\n<li>the content of the quotation is preserved without distortion;<\/li>\n\n\n\n<li>no false impression of support or endorsement by SafeCore is created.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">7.5. The prior written permission of SafeCore is required, in particular, for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>commercial reproduction of materials;<\/li>\n\n\n\n<li>their mass distribution;<\/li>\n\n\n\n<li>their inclusion in paid databases;<\/li>\n\n\n\n<li>the creation of derivative commercial materials;<\/li>\n\n\n\n<li>the use of brand identity elements, logos or other protected designations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">7.6. Requests concerning the use of materials are to be sent to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">8. Trademarks and third-party manufacturers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. The SafeCore name, the SafeCore logo, brand identity elements and the names of solutions and services may be trademarks or other protected designations of SafeCore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.2. The Site may mention products, technologies, names and trademarks of international and Ukrainian manufacturers of software, hardware and solutions in the field of information technology and cybersecurity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.3. All third-party trademarks, logos and trade names belong to their respective owners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.4. A third-party name or trademark may be used on the Site in order to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>identify a compatible product or technology;<\/li>\n\n\n\n<li>describe a solution or a competence;<\/li>\n\n\n\n<li>state a partner or certification status;<\/li>\n\n\n\n<li>make an informational comparison;<\/li>\n\n\n\n<li>refer to the rightholder\u2019s documentation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">8.5. Mentioning a third-party manufacturer does not in itself mean partnership, sponsorship, certification, recommendation or endorsement, unless expressly stated on the relevant page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8.6. Partner statuses, certifications, product availability and licensing rules may change. To obtain up-to-date confirmation, contact SafeCore at <a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a> or check the information on the official resource of the manufacturer concerned.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">9. Information about third-party products and solutions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">9.1. Descriptions of third-party products, their features, characteristics, compatibility, licensing and availability may be based on materials of the relevant manufacturers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.2. Manufacturers may change at any time:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>product characteristics;<\/li>\n\n\n\n<li>the list of features;<\/li>\n\n\n\n<li>system requirements;<\/li>\n\n\n\n<li>licensing models;<\/li>\n\n\n\n<li>prices;<\/li>\n\n\n\n<li>support terms;<\/li>\n\n\n\n<li>lifecycle dates;<\/li>\n\n\n\n<li>geographical availability.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">9.3. Before purchasing or deploying a solution, it is necessary to check the current information in the manufacturer\u2019s official documentation and to agree the specific terms with SafeCore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.4. Manufacturer licence terms, usage rules, privacy policies and other third-party documents apply separately from these Terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">10. Materials available for download<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">10.1. The Site may contain documents, presentations, technical descriptions, instructions, software components, templates or other materials available for download.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.2. The use of such a material may be governed by a separate licence or notice accompanying that material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.3. In the event of a conflict, the separate licence prevails in respect of the material concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.4. Open source components are used in accordance with the terms of the applicable open source software licences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.5. Before opening or running a downloaded material, the User must independently verify its integrity, compatibility and safety.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">11. Enquiries and materials of the User<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">11.1. The User may contact SafeCore by email or through the means of communication available on the Site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.2. By sending messages, files, CVs, technical descriptions or other materials, the User confirms that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>they have the right to send them;<\/li>\n\n\n\n<li>sending them does not violate the law;<\/li>\n\n\n\n<li>the materials do not infringe the rights of third parties;<\/li>\n\n\n\n<li>the materials do not contain malicious code;<\/li>\n\n\n\n<li>sending them does not breach any confidentiality obligations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">11.3. Do not send through general communication channels:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>passwords;<\/li>\n\n\n\n<li>private cryptographic keys;<\/li>\n\n\n\n<li>access secrets;<\/li>\n\n\n\n<li>full backups;<\/li>\n\n\n\n<li>confidential event logs;<\/li>\n\n\n\n<li>payment details;<\/li>\n\n\n\n<li>state or trade secrets;<\/li>\n\n\n\n<li>personal data of third parties without a proper legal basis;<\/li>\n\n\n\n<li>other restricted information.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">11.4. Sending information to <a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a> does not in itself create a non-disclosure agreement or any other confidentiality regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.5. If confidential information has to be shared in order to discuss a project, the parties must first agree the procedure for sharing it and, where necessary, conclude a separate confidentiality agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.6. SafeCore may use the materials received to the extent necessary to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>process the enquiry;<\/li>\n\n\n\n<li>prepare a reply or a proposal;<\/li>\n\n\n\n<li>assess the technical feasibility of cooperation;<\/li>\n\n\n\n<li>consider an application for a vacancy;<\/li>\n\n\n\n<li>ensure information security;<\/li>\n\n\n\n<li>comply with legal obligations;<\/li>\n\n\n\n<li>protect legitimate rights and interests.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">12. Personal data and confidentiality<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">12.1. SafeCore may process personal data that the User voluntarily provides when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sending an email;<\/li>\n\n\n\n<li>filling in a contact form;<\/li>\n\n\n\n<li>sending an application or a request;<\/li>\n\n\n\n<li>submitting a CV;<\/li>\n\n\n\n<li>otherwise interacting with the Site.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">12.2. Such data may include a first name, a surname, the name of an organisation, a job title, a telephone number, an email address, the content of the enquiry and other information provided by the User.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.3. Personal data is processed in accordance with the applicable legislation of Ukraine, as well as in accordance with the GDPR where it applies to the processing concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.4. Detailed information about the purposes, legal bases, retention periods, recipients, international transfers and the rights of data subjects is to be set out in a separate <a href=\"https:\/\/safecore.com.ua\/en\/privacy-policy\/\"><strong>SafeCore Privacy Policy<\/strong><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.5. Questions concerning the processing of personal data may be sent to:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"mailto:info@safecore.com.ua\"><strong>info@safecore.com.ua<\/strong><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.6. If the User provides the personal data of another person, they confirm that they have a proper legal basis for such a transfer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.7. The Site is not intended for the deliberate collection of children\u2019s personal data. Do not send SafeCore a child\u2019s personal data without a proper legal basis and the consent of their legal representative, where such consent is required by law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:3rem\">13. Cookies and technical data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">13.1.
